These general terms and conditions regulate the contractual relationships when purchasing products. Gastroiberico.com offers these products in an online store.
The following established sales and delivery conditions apply only to the contractual relationship between the user (see: customer) of the website Gastroiberico.com and the seller, the company Pieter Temmerman, who owns the online store.
1. GOAL
1.1. The purpose of the terms and conditions is the supply of the products offered in the online shop for a fee.
1.2. By entering the website, the customer is obliged to agree to these rules and conditions.
2. EFFECTIVE DATE
2.1. These terms and conditions, together with the order confirmation, constitute the contract between Gastroiberico.com and the customer for the supply of the products. There are no other terms and conditions.
2.2. As soon as the customer makes a purchase, it is assumed that the customer has read and agreed to these terms and conditions.
3. ORDER
3.1. To place an order, the customer must be at least 18 years old.
3.2. When ordering, the customer agrees to the general terms and conditions.
3.3. After placing an order, the customer receives an e-mail as order confirmation. If an order is not accepted, the customer will also be informed by e-mail.
3.4. It may happen that an ordered product is not in stock. In such a case, we will inform the customer of this and inform about the estimated delivery date or offer an alternative that is at least equivalent. The customer has the right to cancel the order or part of the order.
4. GOODS
4.1 Please read the description of the products carefully before purchasing. The images shown may differ from the final product. If you have any doubts about your choice, please contact us before placing your order.
5. PRICE
5.1. The price of our products is displayed on our website including VAT. However, the price and terms of the products may vary. The valid prices are those applicable at the time the order is placed by the customer.
5.2. The sales prices in our online store are as follows:
All prices are stated including VAT. In the case of intra-Community sales or to customers who are exempt from VAT, this must be indicated under "other comments" in the order form. After verification of the data, the VAT credit will be refunded.
5.3. Shipping costs are not included in the price of the product, with some exceptions. The shipping costs are paid by the customer and are added to the total price of the selected products. The customer will be informed of the exact shipping costs during the checkout process.
5.4. Prices are variable and can be adjusted at any time on our website.
6. AVAILABILITY
6.1 If one of the ordered items is not in stock, we will contact the customer as soon as possible with an indication of the possible delivery time or to offer a product of equivalent quality as an alternative. The customer has the right to cancel his purchase and request a refund.
7. PAYMENT OF PRODUCTS
7.1. To guarantee maximum security of payments, Gastroiberico.com has a partnership with MultiSafepay. When the customer sees the MuliSafepay symbol, the customer can assume that the payment is 100% secure.
7.2. If our security department suspects fraud or irregularities, Gastroiberico.com has the right to cancel the transaction for security reasons.
7.3. Gastroiberico.com offers customers three different payment options:
- Payment by credit/debit card:
If the buyer wishes to pay by credit card, the customer's order can only be recognized and processed once the payment has been approved by the bank. The online credit card payment is made via "HTTPS", which encrypts your credit card information during transmission. For security reasons, Gastroiberico.com checks all orders paid by credit card. We accept Maestro, Visa and MasterCard. For any order whose amount exceeds that set by Gastroiberico.com, you will be asked to send proof of identity and proof of residence by email.
- Payment by bank transfer:
The customer must transfer the final amount to the account provided. After completing the purchase, the customer automatically receives an email containing the bank details to which the money should be transferred. Important: for the transfer, the reference number, which appears when the order is placed, must be given. If the reference number is not provided, the order is invalid and we will refund the money after 7 days.
- Payment via PayPal:
PayPal allows you to pay directly, without providing account details. PayPal encrypts confidential data using the best technologies available on the market.
If you want to conclude an agreement with Paypal, click on the box "Remember Paypal details". You can cancel this agreement by going to your Paypal account.
7.4. If the purchase was made by an end user or a company, an invoice will be drawn up. This invoice consists of the amount of VAT, if applicable, and shipping costs.
8. DELIVERY OF THE PRODUCTS
8.1. Products will be shipped to the delivery address provided by the customer.
8.2. The expected time between ordering and the first delivery attempt by the transport company's employees depends on 2 factors:
1. The shipping time (0-2 days) = confirmation of payment + preparation of the order until the package is handed over to an employee of the transport company. The time for preparing the order depends on the availability of products and any additional services such as cutting or deboning ham.
2. The delivery time of the order is determined by the employees of the transport company. The customer is kept informed via the e-mail "your order has been shipped" of the moment the shipment has taken place and can then track the package via a Track & Trace link provided for this purpose.
8.3. We will deliver the goods as soon as payment has been made correctly and is checked. They are delivered depending on the selected carrier:
• GLS: road transport, delivered within 1-8 working days (depending on the destination).
8.4. The above hours and days refer to working hours and working days, i.e. excluding Saturdays, Sundays and public holidays.
8.5. Delivery is made by the carrier to the specified address. If no one is present at the first delivery attempt, the carrier will try to return at another time or possibly try to deliver to the neighbors. As a final alternative, the package is offered at a GLS Parcelshop nearby. The customer will be informed of this and must collect the products within one week. If this does not happen, the package will be returned to us. In this case, the goods will be refunded to the customer, minus shipping and return costs.
8.6. The delivery times set by us are purely indicative. gastroiberico.com will adhere as much as possible to the agreed term, or failing this, deliver the goods as soon as possible after receipt of the order, but exceeding the agreed term or late delivery does not entitle the customer to claim compensation as no term binds gastroiberico.com, but the right to cancel his or her purchase.
8.7. The customer must notify gastroiberico.com in the event of incomplete or damaged items at the latest 15 days after receipt, and in the event of non-receipt also at the latest 15 days after the order date. The consumer can indicate any delivery address he wishes, provided the address is located within the European Union.
9. REFUND OR RENOVATION RIGHT
9.1 The customer has the right to inform gastroiberico.com that he renounces the purchase without penalty and without stating a reason within 14 calendar days from the day following the delivery of the good or product. on concluding the service agreement by returning the delivered items.
9.2 The return of the delivered items, undamaged, unused and in the original packaging, will be done at the customer's expense to:

9.3 The customer cannot exercise his right of withdrawal if:
the delivered goods are manufactured according to the consumer's specifications, or they have a clearly personal character or the weight is less than 80% of the original weight.
9.4 If you have received a product that is damaged or not as it should be, you must report this immediately upon receipt. Please contact our customer service for this.
9.5 The return of damaged and/or incorrect/defective products is completely free for the customer.
9.6 After receipt in our warehouse, the product is assessed. If we determine that the product is not damaged and/or has no defects, we reserve the right to declare the return void. In this case, returning the products is at the customer's expense.

11. OBLIGATIONS OF THE CUSTOMER AND GASTROIBERICO.COM
11.1. Gastroiberico.com would like to provide its customers with the necessary information for the products offered. Gastroiberico.com is not responsible in the event of force majeure, the absence of the customer or unforeseen circumstances by a person under the contract, and for the non-fulfillment of these conditions.
11.2. The customer declares that he has completed the order form in good faith and correctly. Gastroiberico.com protects the data in accordance with the privacy law. The customer agrees to pay the price of the products, including sales tax and shipping costs.
11.3. We recommend keeping a copy of the data when purchasing the product. Gastroiberico.com is not responsible for the loss of data, files or in general for damages that are not the result of a backup failure.
11.4. Gastroiberico.com is not responsible for the consequences resulting from the incorrect use of our products.
12. REVIEWS
All reviews written by customers are checked by the marketing team. If the reviews are violated against the law, ethics or morals (offensive publicity, slander, insults, comments out of context...), Gastroiberico.com has the right to refuse or edit them.
13. PRIVACY
13.1. The customer's personal data, which is made available to us, is essential for sending orders and issuing invoices. In the absence of this information, the order will be automatically canceled. When registering on our site, the customer agrees to provide us with the valid data. This data is for the provision of services by Gastroiberico.com and the correct identification of the registered customer, as well as the sending of information and advertising for various products and offers that Gastroiberico.com has on its website.

14.1. All contents in the Gastroiberico.com (images, text, names, brands and videos) are the property of Gastroiberico.com. Copying of the contents, in any form, must be prior and expressly approved by Gastroiberico.com.
15. LAW AND JURISDICTION
15.1. This agreement is governed in accordance with Belgian law and European law. Any disputes must be settled by the court of the district of Utrera, Seville.
16. OFFERS AND COUPONS
16.1. Unless otherwise stated in the offer, all promotions and vouchers are valid for one month.
16.2. The discount voucher promotions are only valid on the price of the product and are only applicable once.
16.3. Gastroiberico.com has the right to exclude from the promotion any person who abuses the promotion or uses it multiple times under different identities.
16.4. You can only use one coupon per purchase. Coupons are not cumulative.
